1. Adult Oriented Sites/Material and SPAM
On The Web Unlimited does not host/develop adult oriented sites, or promote the distribution of adult oriented material on the internet.
SPAM will not be allowed or tolerated. (SPAM is the practice of sending bulk unsolicited email.)
Adult oriented material found in the space provided you on our server will be immediately removed and an email warning issued. Any further infractions will be grounds for termination.
If adult oriented material is found on your web site or you are distributing SPAM through our server your site will be removed and your account terminated immediately, without written or prior notice.
Refunds will not be given for terminations of this nature.
No Exceptions!
2. Domain Registration
The responsibility for paying Internic will not be assumed by On The Web Unlimited. Internic will bill you $70.00 directly. On The Web Unlimited charges a $30.00 administrative fee for processing the request.
Your domain will be registered for 2 years. Additional years are charged at $35.00/year. Internic will bill you directly once your domain registration fees are due. It is your responsibility to ensure Internic contact records are current.
You are responsible for your account with On The Web Unlimited regardless of the status of your account with Internic.
3. Payments for Hosting
Hosting fees are paid on a quarterly basis, in advance, and will be sent via US Mail one month in prior to payment being due. Refunds will not be issued for early termination by either party.
A $10 late fee will be assessed for payments received after the fifth of the month.
On The Web Unlimited reserves the right to remove files from the server and cancel all FTP/POP3 access to the server on all accounts 30 days delinquent.
$25.00 charge for bounced checks to be paid the following month. Failure to pay these fees will place the account in a delinquent status.
Hosting agreements and development agreements are separate.
4. Payment for Development
Development work will begin when 50% of the agreed upon price has been received by On The Web Unlimited.
Any remaining balance for development must be received by On The Web Unlimited within 30 days of the completion of the site.
Hosting agreements and development agreements are separate. All fees for hosting must be paid in advance of the site launch.
5. Hosting and/or Development Contract(s)
In an effort to protect all parties, a Hosting Contract and/or Development Contract will be drawn up and signed.
The contract(s) will define roles and responsibilities of the parties involved.
Hosting Contracts will be for a minimum period of 6 months.
A copy of these Terms and Conditions will be included in the contract.
If a client account is terminated for just cause, as described in this document, it does not release the client from their contractual agreement with On The Web Unlimited.
Within 30 days of termination the client must make payment in full for the remaining balance of the contract.
All contracts will have a 72 hour period in which either party may terminate without reason. No legal action may be taken by either party for termination under these conditions.
On The Web Unlimited will not enter into a contract with a minor. If the requesting party is not at least 18 years of age, a parent or legal guardian must sign the contract on their behalf.
